RECOGNITION OF DIVORCE

     Divorce is the dissolution of a marital union. Divorce laws vary around the world and most of the countries require sanction of the court or other authorities to legalize the process.
     For example, although divorce is not allowed in the Philippines, when a marriage of a Filipino national and a foreigner is validly celebrated and a divorce is thereafter validly obtained abroad by the foreign spouse capacitating him/her to remarry, the Filipino spouse shall have the capacity to remarry but only after a judicial decree of absolute divorce of the previous marriage is secured in the Philippine court. Meaning although the divorce is already obtained abroad (like in Japan where you can easily file a divorce registration to the municipal office) or even those divorce rendered by foreign courts, the orders or judgments must be passed upon judicially by the Philippine court to confirm its validity.
